Self-directed 401k FAQ – Can I add my spouse to my Solo 401k even if not an owner of my LLC?

Great question as we have many Solo 401k clients who wish to add their spouse to the Solo 401k to take advantage of the features of our solo 401k including contributions, Mega Backdoor Roth, 401k participant loans, alternative investments, etc..

In order for the spouse to be eligible to participate in the Solo 401k plan, the spouse needs to be working in the business and reporting the spouse’s own earned self-employment income (e.g. a separate Schedule C for the spouse in the case of a self-employed business taxed as a sole proprietorship, a separate w-2 in the case of a self-employed business taxed as an S-corporation, etc.).

There is no requirement for the spouse to be an owner of the self-employed business.
